PENDLETON, President.

Delivered the resolution of the Court.

That as the plaintiff had no day in the Court of Law, his application to a Court of Equity was perfectly regular;

* and, the jurisdiction being admitted, there could be no question upon the merits: Which clearly entitled the plaintiff to relief. That, therefore, the decree was to be reversed, and a perpetual injunction awarded.
