RESPONSE TO ISSUES PRESENTED

The voting by individual members of the Board of the Texas

Department of Motor Vehicles did not extend the Board’s jurisdiction and

was not an “act” of the Board, because the Board did not timely take the

additional steps required by statute: (1) writing an order; (2) signing an

order; and (3) serving the order. Therefore, the motions for rehearing

were overruled by operation of law.

This brief responds and replies to the arguments about jurisdiction

found in the following briefs in this appeal:
