Newman, Judge:

Plaintiff has moved to set aside this court’s order entered on July 16,1976, dismissing the action for lack of prosecution. [163]*163Additionally, plaintiff seeks suspension of tbe case under a pending test case. Defendant opposes setting aside the dismissal on the ground; that plaintiff’s motion fails to comply with thé rulés of the court.

For the reasons stated, plaintiff’s, motion is, denied.
