ORDER

Consistent with the Court’s order granting the Government’s Motion to Correct the

Judgment, the Court issues this order amending the now-vacated judgment issued on January 9,

2026 (ECF No. 237).

On December 23, 2025, Plaintiffs filed a Notice of Partial Acceptance of the United States’

Offer of Judgment in accordance with Rule 68(a) of the Rules of the United States Court of Federal

Claims (“RCFC”). ECF No. 233. As stated by the Government, “[e]ach accepted offer of

judgment concludes all claims for just compensation, including interest, and encompasses any and

all claims for damages and just compensation which were alleged or could have been alleged by

the respective plaintiffs in this action.” Offer of J. at 2, ECF No. 233-1.

As discussed at the status conference held on January 8, 2026, the Court will not enter

judgment at this time in favor of accepting plaintiffs who have a pending or forthcoming motion

for substitution. Additionally, the Court will not enter judgment at this time for certain accepting

plaintiffs who were identified in the chart accompanying the Government’s Offer of Judgment in

a manner that is substantively inconsistent with the Fourth Amended Complaint—i.e., the

description omits a plaintiff’s name, adds a name not identified in the operative complaint, or

identifies the plaintiff as a trust where the named plaintiff is an individual(s). Lastly, as discussed

at the status conference held on January 23, 2026, the Court will not enter judgment at this time

for those plaintiffs named as trusts. See Gov’t’s Mot. to Correct the J. at 1, ECF No. 247 (arguing

that trusts “are not valid parties, cannot have accepted offers of judgment, cannot have judgments

entered in their name, and cannot provide identification numbers for the Department of the

Treasury to meet its statutory obligations under the Debt Collection Improvement Act”).

As for the remaining accepting plaintiffs, the Court has determined pursuant to RCFC 54(b)

that there is no just reason for delay and thus directs the Clerk to enter judgment in favor of the

accepting plaintiffs in the total amount of $1,404,580, for just compensation and interest through

September 30, 2025, plus additional interest of $199.90 per day from September 30, 2025, until

the judgment is paid, to be distributed in accordance with the figures shown in the table below.
